>> I DID WANT TO ACKNOWLEDGE MR. PERERA IN THE BACK. I THINK YOUR DAUGHTER IS HERE. HI GUYS. AND THEN ONE MORE THING.
PRESIDENT HAMILTON, I'M SORRY.
>> LAST BUT NOT LEAST DR. PERERA LOOKS LIKE YOU ARE DOUBLING UP TODAY. THIS IS DEFINITELY SOMETHING A LITTLE SPECIAL. AS THE BOARD OF TRUSTEES WE WANT TO THANK YOU FOR YOUR LEADERSHIP AND GUIDING STUDENTS IN LANCASTER, UNDER YOUR LEADERSHIP THIS INCONSISTENCY AS IT RELATES TO DOING WHAT'S NEEDED FOR THE SUCCESS OF ALL STUDENTS. I WANT TO SHARE A FEW THINGS WE WITNESSED FROM THE SUPERINTENDENT. INNOVATIVE APPROACH TO ADDRESSING THE TEACHER SHORTAGE WITH OUR PROGRAM WE GAINED POSITIVE NATIONAL ATTENTION. WE HAVE HAD NATIONWIDE MEDIA COVERAGE HERE COVERING THAT THE STORY , A STRATEGIC APPROACH TO ADDRESS SOCIAL AND EMOTIONAL NEEDS OF STUDENTS WHILE PROVIDING THERAPY DOGS FOR STUDENTS IN NEED. THAT IS AWESOME AND THE CHILDREN WILL ENJOY THAT. A COLLABORATIVE APPROACH TO ADDRESSING THE NEEDS OF THE DISTRICT WITH CAPITAL OUTLAY COMMITTEE WITH STUDENT AND STAFF COMMUNICATOR GROUPS AND TRANSPARENCY WHEN PRESENTING TO THE BOARD ON THE NEEDS OF THE DISTRICT. THERE ARE SEVERAL THINGS DR. PERERA HAS DONE SINCE SHE HAS BEEN HERE. UPON ARRIVING AT LANCASTER ISD WE HAD SOME ISSUES, BUT SHE WAS ABLE TO HELP US OVERCOME AND GET BACK IN THE SWING OF THINGS SO WE APPRECIATE THAT. I DON'T WANT TO GO ON ALL NIGHT BUT I ALSO WANT TO SAY YOU HAVE PUBLICLY STATED THAT YOU CANNOT ACCOMPLISH THIS WITHOUT YOUR TEAM , THIS WORK CANNOT BE DONE ALONE IT JUST TAKES A GOOD LEADER TO BUILD A TEAM TO GUIDE THE SHIP. WE APPRECIATE YOU FOR YOUR SKILL SET, YOUR EXPERIENCE, YOUR COMPASSION FOR CHILDREN AND WE APPRECIATE WHAT YOU DO AT LANCASTER ISD SO ON BEHALF OF THE BOARD, THANK YOU, THANK YOU , THANK YOU.
SAY SOMETHING? WORK ALONE. IT TAKES A VERY SUPPORTIVE BOARD AND HANDS DOWN THIS BOARD HAS BEEN SUPPORTIVE OF THE INITIATIVES WE PUT BEFORE THEM AND CERTAINLY IN THINGS WE PRESENT ON BEHALF OF THE STUDENTS AND THE STAFF I CANNOT ASK FOR ANY BETTER. AS I SAID I TOLD MONTEL JORDAN, I HAVE TO SAY THE NAME A LITTLE BIT BECAUSE HE SAID MY NAME A FEW TIMES. I WOULD PUT YOU ALL UP AGAINST ANYBODY IN THE NATION. KNOWING I HAVE AMAZING ADMINISTRATORS AND STAFF IN THE BUILDING AS WELL AS THE CABINET, WHEN I LEAVE THE DISTRICT FOR ANY REASON WHATEVER IT IS, I KNOW IT IS IN GOOD HANDS BECAUSE I KNOW I HAVE THE STAFF TO DO THAT. YOU KNOW I LEARNED THAT ON THE BASKETBALL COURT ABOUT THE TEAM AND PLAYING DIFFERENT ROLES WHEN PEOPLE WERE NOT PRESENT AND STEPPING UP WHEN YOU NEED TO AND I DEFINITELY HAVE A CABINET THAT DOES THAT AS WELL AS MY BUILDING TEACHERS AS WELL AS STAFF AND THE ADMINISTRATORS. THANK YOU ALL. THIS IS NOT ABOUT ME, IT'S MORE ABOUT YOU. I HAVE TO BE THE SUPERINTENDENT, I GET THE GOOD, THE BAD AND THE UGLY SO THANK YOU ALL.

[10.A. CTE Updates - LaTasha Murry, Presenter]
THANK YOU. AT THIS TIME WILL MOVE ON TO THE SUPERINTENDENT' S REPORT. CTE UPDATES DR. PERERA>> I WILL CALL TO GET THAT INFORMATION TO THE BOARD AND
COMMUNITY BY MISS MURRY. >> GOOD EVENING MADAME PRESIDENT, DISTINGUISHED BOARD MEMBERS, SUPERINTENDENT PERERA AND COMMUNITY. I AM RELATED TO BRING TO USE SOME OF THE GREAT THINGS GOING ON IN THE CAREER TECH AND EDUCATION DEPARTMENT.
AS YOU CAN SEE FROM THIS SLIDE, THIS IMAGE WE ARE INTENTIONAL ABOUT ENSURING THAT EVERYONE SEES THEMSELVES IN THE DISTRICT ON. WE WANT TO REMIND YOU THAT WE ARE VERY INTENTIONAL ABOUT MEETING BY PROVIDING THE WORLD-CLASS TEACHING AND LEARNING EXPERIENCES. FOR OUR STUDENTS AND IN THE CAREER TECHNICAL EDUCATION PROGRAMS, WE PROVIDE A COHERENT SEQUENCE OF COURSES THAT ARE RIGOROUS AND CHALLENGING AND RELEVANT FOR OUR LEARNERS. IN OUR COMPREHENSIVE STEAM LEARNING PLAN WE HAVE SEVERAL COMPONENTS AND CTE DEFINITELY HELPS US WITH THE INDUSTRY CONNECTIONS AND HANDS-ON LEARNING EXPERIENCES. AS WAS STATED EARLIER IT IS NATIONAL CTE MONTH AND WE CELEBRATE OUR CTE TEACHERS BECAUSE THEY ARE DOING A PHENOMENAL JOB OF WHICH I WILL MENTION SOME OF THE THINGS IN A MOMENT. DURING THIS MONTH WE HAD OUR CTE BUSINESS MIXER WITH POTENTIAL BUSINESS PARTNERS AND I WILL SPEAK MORE TO THAT IN A MOMENT. WE ALSO PARTICIPATED IN THE INAUGURAL SOUTHWEST STEAM COMPETITION AND EXPO. WE WON SECOND PLACE OVERALL. WE WON'T TALK ABOUT HOW RED OAK WON FIRST PLACE AND IT WAS IN RED OAK. NONETHELESS WE ARE COMING FOR THEM. WE ARE LOOKING FOR FIRST PLACE NEXT YEAR. WE DID PARTICIPATE . WE HAD CAREER PRESENTATIONS FROM SOME BUSINESS PARTNERS, TOYOTA, CANON, LOCKHEED MARTIN, STUDENTS HAVE BEEN ON FIELD TRIPS TO SOME OF THESE COMPANIES AND WE WILL CONTINUE TO CELEBRATE STAFF THIS MONTH.
I WANT TO HIGHLIGHT A FEW TEACHERS ACTUALLY. RECENTLY GOT LICENSED IN BARBERING, SHE WAS ALREADY THE COSMETOLOGY TEACHER SO WITH THAT WORK AND DEDICATION WE ARE ABLE TO PROVIDE BARBERING TO STUDENTS NOW SO WE ARE EXCITED ABOUT ADDING THAT PROGRAM. WE HAD A SURPRISE UNANNOUNCED INSPECTION AND SHE RECEIVED A SUPERIOR RATING DURING THE INSPECTION AND WAS TAGGED AS A UNICORN FOR BEING ABLE TO OFFER BOTH BARBERING AND COSMETOLOGY. PLEASE KNOW THAT OUR LAB IS BEING RENOVATED. LOOK FORWARD TO THAT RIBBON-CUTTING CEREMONY. IT IS AWESOME. WE ALSO WANT TO RECOGNIZE NAME ] IS DEDICATED TO CONTINUING EDUCATION OF NOT ONLY STUDENTS, BUT STILL EDUCATORS, COLLEAGUES AND SHE RECENTLY PUBLISHED A BOOK ENTITLED CLASSROOM CATALYST DAILY SPARKS FOR EDUCATIONAL EXCELLENCE FOR TEACHERS IN THE FIELD. SO WE CELEBRATE MISS GRANT. I DO NOT GET AN OPPORTUNITY. COP IT UP, CLAP IT UP. I'M GOING TO MENTION A COUPLE OF OTHER PEOPLE THAT ARE WITH US. I DID NOT GET AN OPPORTUNITY TO ADD THOSE LOTS, BUT JUST WAIT. I DID MENTION THE THE SOUTHWEST EXPO, WE PARTICIPATED IN ROBOTICS ENGINEERING 3-D DESIGN, DRONE AND E SPORTS AND EVEN THOUGH WE DON'T HAVE A ESPORTS PROGRAM OF STUDY WE HAVE A CLUB AND THE CTE DEPARTMENT SUPPORTS THE STUDENTS IN THAT CLUB SO WE DID COMPETE THERE AND AGAIN WE WON SECOND PLACE OVERALL.
THOSE EFFORTS WERE LED BY A COUPLE OF TEACHERS. MOSTLY MR. LEON JAMES WHO IS NOT WITH US THIS EVENING. SOME OF THOSE AUTHENTIC LEARNING AND FIELD EXPERIENCES THAT I MENTIONED, PROVIDING STUDENTS WITH WORLD-CLASS TEACHING AND
[00:35:01]
LEARNING, INCLUDES THE PARTICIPATION WITH BUSINESS PARTNERS , WE HAD THE WALMART DISTRIBUTION FULFILLMENT CENTER HERE IN THE DISTRICT WITH OUR PARTNERSHIP LUNCHEON THAT I WILL TALK MORE ABOUT. PARTICIPATING IN COMPETITIONS.NOT ONLY DID WE PARTICIPATE IN THE SOUTHWEST STEAM COMPETITION, BUT WE ARE CURRENTLY PARTICIPATING IN THE COSMETOLOGY SKILLS USA COMPETITION. NOW EXPECTING AT LEAST THREE OR FOUR FIRST PLACES. OKAY. SO EXCITED ABOUT THAT, WE WILL KNOW THOSE OUTCOMES THIS WEEKEND I BELIEVE. RECENTLY ] ON THE CULINARY TEAM WON FIRST PLACE AT THE COCHRAN FIRM CULINARY COMPETITION. LET'S GIVE IT UP. NOW I WAS TOLD ONE OF THE JUDGES TOLD EVERYBODY AT THE COMPETITION THAT ANY OF THOSE OTHER DISTRICTS HAD AN OPPORTUNITY TO PLACE FIRST. IF LANCASTER HAD NOT SHOWN UP. SO SHOUT OUT TO CULINARY TEAM. WE HAVE A COUPLE OF EXCITING EVENTS THAT I WANT TO MENTION HERE WITH EDUCATION AND TRAINING PROGRAM LED BY MISS STINSON WHO IS ALSO WITH US TONIGHT. YES, MISS STINSON . IN ALIGNMENT WITH OUR STRATEGIC STEAM VISION AND MISSION , STEAM FOR ALL, OUR STUDENTS IN THE EDUCATION TRAINING PATHWAY WILL PARTICIPATE IN A DAY OF STEAM PEDAGOGY PROFESSIONAL LEARNING. AS IF THEY ARE EDUCATORS WITH DEFINED LEARNING. WE ARE EXCITED ABOUT THAT COMING UP.
WE ARE ALSO PUTTING AN EDUCATION AND TRAINING SUMMIT WITH OUR STUDENTS AND WE WILL INVITE EDUCATION AND TRAINING STUDENTS FROM OTHER SURROUNDING DISTRICTS. THIS SUMMIT IS GOING TO FOCUS ON THE FUTURE OF EDUCATION. WHAT IS EDUCATION GOING TO LOOK LIKE? WE ARE THINKING WHAT WILL EDUCATION LOOK LIKE? REALLY FOCUSING ON ARTIFICIAL INTELLIGENCE AND A TRANSFER OF TECHNOLOGIES. THOUGH STUDENTS WOULD PARTICIPATE IN WORKSHOPS AROUND THOSE AREAS AS WELL AS GETS THEM DEVELOPING AND BE ABLE TO TALK TO SOME EDUCATORS ABOUT THE FUTURE OF EDUCATION. SO THAT THE EDUCATION SUMMIT COMING UP AND WE ARE EXCITED ABOUT THAT AS WELL. ONE MORE EVENT I WANT TO TELL YOU ABOUT COMING UP IS THE YOUTH ENTREPRENEUR ORAL AND FINANCIAL LITERACY SUMMIT. THIS IS STUDENT LED, BUT THEY ARE ADVISED THAT THIS IS A COLLABORATION BETWEEN THE COMPREHENSIVE SIDE OF STUDENT COUNCIL LEADERS AS WELL AS THE EARLY COLLEGE BOARD OF PEERS.
SO, THEY ARE PUTTING ON THIS EVENT FOR YOUTH ENTREPRENEURS WHICH WILL COME IN APRIL SWEAR IN THE FANNING PLACES OF THAT.
WE WILL BE THERE WE HOPE ALL OF YOU WILL JOIN US WHEN WE GET THAT INFORMATION AND SUPPORT OUR YOUTH ENTREPRENEURS. ALSO THE STATE UNDERWENT A CTE REFRESH AND OF COURSE WE HAVE TO REEVALUATE THE PROGRAMS OF STUDY THAT WE OFFER. I AM VERY PLEASED TO ANNOUNCE IN COLLABORATION WITH OUR ATHLETICS DEPARTMENT AND FOR THOSE OF YOU WHO DID NOT HEAR IT EARLIER, A IS ARTS AND ATHLETICS. SO IN ALIGNMENT WITH THAT VISION AND MISSION IN COLLABORATION WITH ATHLETICS DEPARTMENT WE ARE ADDING SPORTS MEDICINE TO OUR HEALTH SCIENCE CLUSTER. CLAP IT UP, CLAP IT UP. WE ARE ALSO ADDING NOW, THIS IS NOT IN ADDITION. WE WERE BRINGING IT BACK, BUT IT HAS BEEN REFRESHED , ROBOTICS AND AUTOMATION. IF YOU HAVE BEEN HERE HE WHILE WE DID HAVE ROBOTICS, WE CAN HAVE CHANGED THE FOCUS TO DRONE TECHNOLOGY. NOW WE ARE BRINGING BACK ROBOTICS AND WE WILL HAVE ROBOTICS AND DRONE. SO WE ARE PHASING OUT ELECTRICAL AND YOU WILL SEE SOME HIGHLIGHTED PROGRAMS THERE AND THAT IS BECAUSE WE ARE AWAITING RESPONSE FOR OUR PROGRAM AND TECHNOLOGY EARLY COLLEGE HIGH SCHOOL APPLICATION AND WE APPLIED FOR NOT ONE PROGRAM BUT TWO BECAUSE WE HAVE TWO AMAZING HIGHER EDUCATION PARTNERS SO WE'RE HOPING TO PARTNER WITH DALLAS COLLEGE FOR HEALTH SCIENCE PATHWAY AND MCMURRAY UNIVERSITY FOR EDUCATION AND TRAINING PATHWAY. CLAP IT UP.
ONE OTHER THING ABOUT OUR PROGRAMS , MCMURRAY UNIVERSITY
[00:40:04]
FRESH OFF THE PRESS RELEASED THEY ARE OFFERING FOUR COURSES IN CYBER SECURITY FOR THE DUAL ENROLLMENT. YES, YES YES YES. WITH THE SUPPORT WITH MY DISTRICT, OUR DISTRICT LEADERS , IN FULL SUPPORT OF OUR DISTRICT LEADERS WE WILL OFFER CYBER SECURITY AS A DUAL ENROLLMENT PROGRAM IN THAT PARTNERSHIP . SO WE ARE EXCITED ABOUT THAT. NOT ONLY THAT, WE WANT TO INCREASE THE ADVANCED ACADEMIC OPPORTUNITIES FOR STUDENTS. WE CURRENTLY HAVE ZERO TOOL CREDIT OPPORTUNITIES IN THE CAREER INTAKE EDUCATION DEPARTMENT. I MAY HAVE GONE A LITTLE BIT OVERBOARD, BUT I HAVE SOME AMAZING TEACHERS WHO ARE ELIGIBLE BE CREDENTIALED ON CAMPUS, WE HAVE FOUR TEACHERS THAT WE SUBMITTED APPLICATIONS FOR THEM TO BE CREDENTIALED WITH DALLAS COLLEGE. SO THIS IS A LIST OF APPROXIMATELY NINE AND THIS DOES NOT INCLUDE CYBER SECURITY. NINE POTENTIAL TOOL CREDIT OPPORTUNITIES THAT HAS BEEN EVALUATED RIGHT NOW AND WE ARE WAITING ON THE RESPONSE FROM DALLAS COLLEGE FOR THE FIRST I BELIEVE FIVE AND THEN YOU WILL SEE THE LAST THREE ARE FROM MCMURRAY AND WE ALREADY HAVE THAT PARTNERSHIP THAT IS APPROVED SO WE CAN MOVE FORWARD IN OFFERING THOSE DUAL CREDIT OPPORTUNITIES FOR OUR STUDENTS.I DID WANT TO BREAK THIS DOWN BECAUSE THIS IS HUGE IN MY EYESIGHT. CYBER SECURITY DUAL CREDIT PROGRAM THE STUDENT WILL START LEVEL III AND THE STUDENT OTENTIALLY BE A JUNIOR OR A SOPHOMORE STARTING THESE DUAL CREDIT OPPORTUNITIES BECAUSE THEY ASKED OUR MIDDLE SCHOOL AND PRINCIPLES WE HAVE STARTED CTE STRATEGICALLY DOWN SO I AM EXCITED ABOUT THAT.
WITH THAT EARLY START THEY COULD POTENTIALLY BE A SOPHOMORE IN THE LEVEL III COURSE OR A JUNIOR IN LEVEL III COURSE. SO AGAIN THEY WILL BEGIN TAKING THESE DUAL CREDIT OPPORTUNITIES AND YOU SEE THE ALIGNMENT AND STUDENTS IN THIS PATHWAY HAVE A POTENTIAL TO EARN 12 CREDIT HOURS JUST IN CTE BEFORE THEY GRADUATE. SO I AM EXCITED ABOUT THAT.
CERTIFICATIONS THAT STUDENTS ARE PURSUING. WE HAVE ADDED QUITE A FEW FROM SOME YEARS BEFORE I WILL LET YOU KNOW THIS IS CERTIFICATION SEASON, SO I LOOK FORWARD TO MORE CERTIFICATION COMING. HOWEVER, WE CURRENTLY ALREADY HAVE SIX THAT HAVE COMPLETED AND HAVE CERTIFICATION IN ENTREPRENEURSHIP AND SMALL BUSINESS. 64 FROM CULINARY WITH SERVICES MANAGER AND I'M SUPER EXCITED WE HAVE 16 STUDENTS READY TO TAKE THEIR DRONE PILOT CERTIFICATION. NOW THAT IS WITH THE FEDERAL AVIATION AUTHORITY. THAT IS A VERY COLLOCATED PROCESS, WE ARE TRYING TO NAVIGATE THOSE WATERS. I AM EXCITED TO GET THE STUDENTS TESTED AND GET THEM THE DRONE PILOT CERTIFICATION. YES. THANK YOU FOR CLAPPING.
GIVING ME TIME TO BREATHE. WE DO HAVE A STUDENT THAT HAS SUBMITTED HIS APPLICATION FOR EDUCATION AID, ONE OF OUR SENIORS AND HE IS IN THE FINGERPRINTING PROCESS. SO WE DO HAVE A STUDENT AND THOUGH STUDENTS HAVE TO BE 18 BEFORE THEY CAN SUBMIT THEIR APPLICATION. THESE ARE MORE CERTIFICATIONS THAT STUDENTS ARE PURSUING. SO, KNOW THAT TEACHERS ARE WORKING HARD TO MAKE SURE STUDENTS ARE CAREER READY BEFORE THEY GRADUATE. WHEN THEY GRADUATE FROM LANCASTER HIGH SCHOOL. I MENTIONED THE BUSINESS MIXER.
WE WERE EXCITED ABOUT THE TURNOUT, DR. BENJAMIN HARGROVE LED THE EFFORT. WE HAD MORE THAN 20 BUSINESS PARTNERS IN ATTENDANCE AND I WANTED TO POINT OUT SOME OF THOSE BUSINESS PARTNERS ARE STRATEGIC BUSINESS PARTNERS, SOME ARE SUPPORT BUSINESS PARTNERS, SOME ARE HIGHER EDUCATION BUSINESS PARTNERS. SO WE ARE EXCITED TO REESTABLISH RELATIONSHIPS AND OPPORTUNITIES WITH AND YOU WILL HEAR LATER ON ABOUT 21ST AND EDUCATION.
EXCUSE ME IN ATTENDANCE WE WERE EXCITED TO HEAR THE OPPORTUNITIES THAT THEY HAD. WE HAD SOME STRATEGIC PLANNING PARTNERS SUCH AS
[00:45:08]
DO WANT TO SAY THIS. WE ARE IN DISCUSSION WITH BOTH PARKLAND AND METHODIST TO BE POTENTIAL PARTNERS FOR HEALTH SCIENCE PROGRAMS. EXCITED ABOUT THAT, TOO. AND, THANK YOU FOR ALLOWING ME TO SHARE.QUESTIONS OR COMMENTS? MISS MORRIS.
>> THANK YOU VERY MUCH FOR CYBER SECURITY. THOSE THAT DON'T KNOW, THAT'S REALLY HUGE. FOR WHAT IT'S WORTH YOU HAVE STOOD UP YOUR PROGRAM QUICKER THAN DALLAS COLLEGE
COULD STAND UP THERE'S. >> THANK YOU SO MUCH. NEXT ON
[10.B. December 2023 Financial Reports CCA(LOCAL) - (G2) - Dana Shaw Mosley, Presenter]
THE SUPERINTENDENTS REPORT WE HAVE DECEMBER 2023 FINANCIAL REPORTS CCA LOCAL, DR. PERERA .>> GOING TO CALL FORWARD TO THE PODIUM MISS MOSTLY TO PRESENT THAT INFORMATION TO THE BOARD AND OUR COMMUNITY.
>> GOOD AFTERNOON BOARD PRESIDENT, MEMBERS AND DR.
PERERA I PRESENT THE DECEMBER 2023 MONTHLY FINANCIAL REPORT.
FIRST REPORT ON SLIDE ONE IS THE TASK ELECTION REPORT DECEMBER 2023 THIS REPORT GENERATED STREET FROM THE DALLAS COUNTY TAX OFFICE AND WAS IN YOUR PACKET FOR REVIEW.
THESE ARE COLLECTIONS FOR DECEMBER. MAINTENANCE OPERATION AND INTEREST. THE NEXT SLIDE TWO REPRESENTS THE GENERAL FUND FINANCIAL SUMMARY FOR THE PERIOD ENDING DECEMBER 2023.
THE TOP PORTION REPRESENTS FISCAL YEAR 2023 YEAR TO DATE AT THE SAME TIME PERIOD AS THE CURRENT FISCAL YEAR YEAR TO DATE NUMBERS. FOR REVENUE OVERALL WE HAVE COLLECTED 37% OF THE TOTAL BUDGET REVENUE FOR THE FISCAL YEAR. CHARGED REVENUE IS DOWN DUE TO STATE OF TEXAS HAD AN AUDIT FROM THE DEPARTMENT OF EDUCATION AND THEY HAVE CUT REVENUE PROJECTIONS FOR ALL SCHOOL DISTRICTS AND THE IMPACT OF US WAS $680,000. EXPENDITURES ARE APPROXIMATELY 33% EXPENDED AND AT THIS TIME LAST YEAR WE HAD 33% EXTENDED, THIS YEAR WE HAVE 37% BUDGET EXPENDITURE EXPENDED. THE TOTAL, WE BEGIN TO COLLECT REVENUE FOR TAX COLLECTION IN DECEMBER SO THAT'S WHY YOU CAN SEE THE LARGE TAX REVENUE COLLECTIONS.
SOME OTHER HIGHLIGHT SO WE SPENT LESS IN INSTRUCTION AND INSTRUCTIONAL SERVICES CURRENTLY YEAR TO DATE THAN WE DID LAST YEAR AND THERE'S INCREASE IN SPENDING AT THIS TIME . AT THE PERIOD LAST YEAR I'M SORRY. SLIDE THREE THIS GRAPH REPRESENTS THE TOP 10 SOURCES OF REVENUE . THE DISTRICT HAS COLLECTED 1/3 OF THE REVENUE BUDGETED AND THE FEDERAL REVENUE COLLECTIONS ARE DOWN BECAUSE OF THE COLLECTION AND AGAIN DUE TO THE DEPARTMENT OF EDUCATION AUDIT AND ALL THE SCHOOL DISTRICTS THAT HAVE CUT WITHIN THE STATE OF TEXAS. SLIDE FOUR REPRESENTS THE TOP 10 DRIVERS OF EXPENDITURES, INSTRUCTION BEING THE HIGHEST DRIVER WITH MAJORITY OF EXPENDITURE COST OR PAYROLL. SLIDE FIVE REPRESENTS FOOD SERVICES DEPARTMENT CURRENTLY WE HAVE A $2.2 MILLION DEFICIT AND THIS IS DUE TO BECAUSE THE AUDIT IS STILL PENDING AND WE ARE AWAITING REVENUE COLLECTION.
ALL THE REVENUE COLLECTED IS FROM LOCAL SNACKS TO THE CHILDREN IN THE CAFETERIA. SLIDE SIX REPRESENTS DEBT SERVICE COLLECTIONS YEAR TO DATE AS OF DECEMBER 31ST 2023.
ALL OF THE REVENUE IS FROM THE TAX COLLECTION. WE HAVE NOT EXPENDED YEAR TODAY PAYMENTS BECAUSE DEBT PAYMENTS ARE MADE IN FEBRUARY. SLIDE SEVEN IS JUST INVESTMENT REPORT RECONCILIATION AS WE RECONCILE GENERAL LEDGER TO DALLAS COUNTY TAX RECORDS TO INVESTMENT STATEMENT. THIS IS A UPDATE OF WHY REVENUES ARE GETTING CUT BECAUSE WE HAD AN AUDIT FROM THE DEPARTMENT OF EDUCATION AND WE WANT TO POTENTIALLY LOSE $680,000. STILL AWAITING RESULTS FROM OUR THIRD-PARTY
[00:50:03]
WORKING WITH THE STATE BECAUSE WE HAVE AN APPEAL IN PLACE NOW BUT WE DO NOT KNOW THE OUTCOME AT THIS TIME.ANY QUESTIONS? >> QUESTIONS COMMENTS?
>> MADAM PRESIDENT. REALLY REALLY QUICK QUESTION. SHOULD HAVE ASKED BEFORE BUT THE PRINT WAS TOO HARD TO READ. ON PAGE 3 WE HAVE RENT AS A REVENUE, WHAT ARE WE RENTING? I'M GUESSING ATHLETIC FACILITIES?
>> WE HAVE RENT THAT COMES IN FROM LEASING THE TOWERS. RENT FROM DALLAS ISD FROM THE BUS BARN, THEY RENT SPACE.
>> THANK YOU. >> ANY OTHER QUESTIONS? THANK YOU SO MUCH.
[10.C. Campus Highlights]
LANCASTER HIGH SCHOOL DR. PERERA>> THANK YOU MADAM PRESIDENT, I WILL CALL FORWARD MISS KIRSTEN JETT TO PRESENT THAT INFORMATION. THE FLOOR IS
YOURS. >> GOOD AFTERNOON MADAM BOARD PRESIDENT, ESTEEM BOARD MEMBERS AND DR. PERERA I WILL BE PRESENTING THE LHS CAMPUS HIGHLIGHTS FOR YOU THIS EVENING. I WILL BEGIN BY INTRODUCING THE TEAM THAT SERVE AND SUPPORT STUDENTS AT LANCASTER HIGH SCHOOL BEGIN WITH ADMINISTRATIVE TEAM ON THE LEFT, ASSOCIATE PRINCIPLES MR. STRICKLAND AND MISS THOMPSON, ASSISTANT PRINCIPALS COUNSELORS, ACADEMIC COUNSELORS, NAME ] ENTER 35, COUNSELOR LHS IS INCREASING ENROLLMENT WITH 11TH AND 12TH GRADE COHORT INCREASING THE MOST FROM LAST YEAR. WE HAVE SEEN OVERALL INCREASE OF ENROLLMENT OF ABOUT 6% FOR THIS ACADEMIC SCHOOL YEAR. THIS SLIDE REPRESENTS OUR PROMISE, SPECIAL EDUCATION AND BILINGUAL POPULATION. YOU WILL NOTICE WE HAVE A GROWING NUMBER IN THE EMERGING BILINGUAL POPULATION SO WE ARE LOOKING TO GET ADDITIONAL SUPPORT AND RESOURCES TO SUPPORT THE GROWING POPULATION OF STUDENTS.
WE CURRENTLY HAVE 11 FACULTY MEMBERS WORKING TOWARD CERTIFICATION OUT OF A TOTAL OF 88. THIS NEXT SLIDE REPRESENTS OUR EEOC STAR DECEMBER RETEST INFORMATION. I WANT TO TAKE A MOMENT TO LOOK AT THIS DATA. WHAT YOU CAN SEE IN THE ORANGES WHERE WE STARTED AT THE BEGINNING OF THIS YEAR AND THAT IS BROKEN DOWN BY EACH GRADE LEVEL COHORT. IN THE BLACK IS WHERE WE ARE CURRENTLY FOR THE DECEMBER STAR RESULTS WE JUST GOT BACK IN JANUARY. SO, OVERALL WE DECREASED THE NUMBER OF STUDENTS WHO NEEDED TO RETEST IN EACH OF THE FIVE TESTED AREAS , ALGEBRA ONE DECREASED BY 39%, BIOLOGY DECREASED BY 56%, ENGLISH ONE DECREASED BY 38%, ENGLISH TO DECREASED BY 29% AND US HISTORY DECREASED BY 62%. THAT WAS A BIG GOAL FOR US THIS YEAR TO DECREASE THE NUMBER OF RETEST AT THE FIRST TEST AND WE'RE LOOKING TO EVEN LESSEN THOSE NUMBERS FOR SPRING TESTING AS WELL. ONE OF OUR OTHER GOALS IS TO IMPROVE IN THE AREA OF ADVANCED ACADEMICS, AS YOU HEARD WE ARE LOOKING TO EXPAND OUR PROGRAM OFFERINGS, BUT WE DO NEED TO IMPROVE IN THE PARTICULAR AREA OF READINESS IN GETTING STUDENTS READY FOR THOSE ADVANCED LEVEL COURSES, AS YOU CAN SEE. WE HAVE A GROWTH OPPORTUNITY HERE FOR ACT AND TSI TESTING. THIS LETTER REPRESENTS CURRENT DUAL CREDIT ENROLLMENT FROM THE FALL. AS YOU CAN SEE WE WERE SUCCESSFUL WITH MATH, SPANISH, GOVERNMENT AND BUSINESS. WE HAVE AN AREA OF OPPORTUNITY TO GROW IN THE AREA OF ENGLISH FOR DUAL CREDIT STUDENTS. [00:55:01]
THAT APPLICATION PROCESS THAT DID CHANGE PRETTY HEAVILY THIS YEAR FOR THE NEW APPLICATION. OUR DISCIPLINED DATA SLIDE REVEALS A NOTICEABLE IMPROVEMENT WITH A SIGNIFICANT DECREASE IN CAMPUS ALTERCATIONS. LAST YEAR FALL OF 22 THERE WERE 55 CAMPUS FIGHTS THIS YEAR , THIS PAST FALL DROPPED DOWN TO 25 . SO WE ARE SHOWING A POSITIVE TREND FROM THE PRIOR SCHOOL YEAR. ONE OF THE WAYS WE DO THIS IS THROUGH IMPROVING STUDENT CULTURE, OUR STUDENTS LOVE THEME DAYS SO AS YOU SEE PICTURED HERE, THERE ARE A VARIETY OF THEME DAYS WE DO THROUGHOUT THE YEAR TO PROMOTE A POSITIVE STUDENT CULTURE. THESE ARE ORGANIZED BY STUDENT LEADERSHIP GROUP, THE STUDENT COUNCIL. THERE IS MORE PICTURES, THERE IS A PICTURE FROM OUR PEP RALLY AND THE ONE ON THE LEFT IS THE THROWBACK, THEY THINK THE 90S IS THROWBACK. I DON'T. WE ALSO HIGHLIGHT OUR ACADEMICS FOR THE HONOR ROLL. WE HOSTED A CLUB AND ORGANIZATION TO PROMOTE STUDENT INVOLVEMENT AND DIFFERENT ACTIVITIES ON CAMPUS.EACH CLASS HOST DIFFERENT SOCIAL EVENTS TO HAVE COMMANDERY AMONGST THEIR CLASSMATES. WE LOVE ON OUR STAFF AS WELL, WE FEED THEM A LOT, WE OFFER CATERED BREAKFAST DUE TO THE AMAZING CORNER PROGRAM, CATERED LUNCH, CATERED BREAKFAST. STAFF LIKES TO PARTICIPATE IN THEME DAYS AS YOU CAN SEE AND ON THE LEFT YOU WILL SEE THE PICTURE OF STAFF COMPETING AGAINST THE STUDENTS AND THE DODGEBALL COMPETITION DURING A PEP RALLY. WE ALSO HAD A STAFF VERSUS STUDENT BASKETBALL GAME AND I'M HAPPY TO REPORT WE ARE UNDEFEATED AGAINST THE STUDENTS THIS YEAR. OUR COMMUNITY PARTNERSHIP HAS GROWN , THIS YEAR WE HOSTED THE FIRST ALL PRO DANCE WE ARE A ALL-PRO DAD SITE WE HAD THE FIRST MEETING WITH 23 DADS PRESENT IN DECEMBER AND HOPE TO DOUBLE THAT BY THE END OF THE YEAR. WE WERE VISITED BY THE ATF DEPUTY DIRECTOR MARVIN RICHARDSON WHO TALKED WITH A GROUP OF STUDENTS ABOUT HIS CAREER PATH AND CHOICES HE MADE TO INSPIRE STUDENTS WHO MAY BE LOOKING TO GO INTO LAW ENFORCEMENT OR A DIFFERENT PATH. HOME DEPOT SPONSORED BARBECUE CLUB THIS YEAR AND DONATED A GRILL SO THAT HAS BEEN A PLEASANT DELIGHT FOR STAFF AND STUDENTS BECAUSE WE HAVE BEEN ABLE TO UTILIZE AND CELEBRATE OUR STAFF AND STUDENTS WITH THE DONATED GROUP. OUR CAMPUS GROWS, AREAS OF IMPROVEMENT FOR US WE ARE WORKING TO WORK ON CAMPUS ATTENDANCE SUPPORTING BILINGUAL POPULATION AND THEN INCREASE READINESS FOR ADVANCED ACADEMICS. OUR GOALS, WE HAVE REDUCTION IN CAMPUS FIGHTING INCIDENTS FROM LAST YEAR UNTIL THIS YEAR. WE SAW SIGNIFICANT IMPROVEMENT WITH EEOC RE-TESTERS AND TO DATE THE CLASS OF 2024 HAS EARNED OVER $11 MILLION IN SCHOLARSHIPS. SO THAT IS AS OF RIGHT NOW. THANK YOU FOR YOUR TIME.
COMMENTS FROM THE BOARD? >> I HAVE A COMMENT. FIRST I WOULD LIKE TO TAKE THIS TIME AND EXPRESS MY GRATITUDE AND GRATEFULNESS FOR THE LANCASTER ISD STAFF, ESPECIALLY TEACHERS WHO REMAIN ON THE FRONT LINE FOR STUDENTS AND STANDING STEADFAST WITH INTEGRITY AND THEIR FAITH AND COMMITMENT TO OUR STUDENTS AND EACH OTHER. I AM REALLY AT WITH WHAT I HAVE BEEN ABLE TO WITNESS THUS FAR AS IT RELATES TO THE GROWTH ON OUR CAMPUSES AND FOR ME YOU KNOW IT IS ALL ABOUT THE STUDENTS AND THE FOCUS OF THE STUDENTS AND WHAT I AM SEEING AS IT RELATES TO WHAT OUR TEACHERS AND PRINCIPALS AND ONBOARD STAFF ARE DOING, THAT IS FOCUSING ON THE STUDENTS.
AND TO SEE THE STUDENTS INTERACT AND THE TEACHERS INTERACTING, THE CHANGES THAT HAVE TAKEN PLACE THAT TRUE INTERVIEW TO GROWTH ON A LOCAL LEVEL. IT SPEAKS FOR ITSELF.
I UNDERSTAND THAT SOME OF THE SCORES HAVE DROPPED AND YOU KNOW WITH EVERYTHING THAT CAME BACK WE HAVE A LOT TO WORK ON.

[13.A. Discussion with TEA Conservator concerning roles and responsibilities of Trustees. (Tex. Gov't Code §551.074(a)(1) - Dr. Carol Francois, TEA Conservator, Presenter]
>> WE WILL NOW MOVE TO BOARD MATTERS. DISCUSSION WITH TO CONSERVATOR CONCERNING ROLES AND RESPONSIBILITIES OF TRUSTEES TEXAS GOVERNMENT CODE 551.074 DR. CAROL FRANCOIS.
>> BETTER PRESIDENT, SORRY I WOULD LIKE TO MAKE A STATEMENT BEFORE. I WANT TO THANK THE BOARD, THANK YOU MADAM PRESIDENT FOR PRESENTING THIS AWARD TONIGHT TO ME. I KNOW THAT WE HAVE HAD A TOUGH LAST THREE YEARS . I WANT TO SAY PUBLICLY THANK YOU TO DR. PERERA AS WELL. SHE CAME INTO OUR DISTRICT READY TO WORK. NOT ALLOWING DISTRACTIONS TO KEEP HER SILENT WERE MOVING FOR OUR CHILDREN BECAUSE THAT'S WHEN SHE CAME IN AND EVEN THOUGH SHE'S REPEATING AND SHE STAYS FOCUSED WHERE WE ARE ABLE TO GET PROGRAMS AND DO THINGS AND I'M SO GRATEFUL. I WANT TO ALSO SAY THAT MADAM PRESIDENT , I REALLY TRULY ACCEPT AND APPRECIATE YOUR STATE AND. THAT YOU MADE TONIGHT. WE AS A BOARD HAVE TO WORK TOGETHER AND I THINK THAT WE CAN BE OKAY. I KNOW WE CAN BE OKAY , IT IS OKAY AND SO MOVING FORWARD , LET'S JUST , THEY WILL TELL US A LOT OF THINGS. LET'S TAKE HEED TO WHAT SHE IS SAYING. TAKE HEED TO WHERE OUR SUPERINTENDENT IS TAKING US AND WE ARE READY TO MOVE FORWARD. THANK YOU AND THANK ALL OF THE TEACHERS. I WANT TO GIVE A SPECIAL THANKS FOR COACH BROWN, THANK YOU. THAT IS BECAUSE EVERY TIME I WALK IN THE GYM, YOU HAVE A SMILE AND YOU ALWAYS SAY SOMETHING. I REALLY APPRECIATE THAT, THANK YOU.
>> GREAT, THANK YOU. I WHAT EVER BACK TO THE TA CONSERVATIVE REPORT, DR. CAROL FRANCOIS.
>> THANK YOU, CONGRATULATIONS TRUSTEE MORRIS AND SUPERINTENDENT PERERA. OUTSTANDING WORK. THE REPORT I AM GIVING THIS EVENING AS USUAL IS A MONTHLY ARREARS BASED ON JANUARY 2024 . THE FULL REPORT CAN BE FOUND IN YOUR BOARD BOOK AND IT IS ALSO POSTED ON THE WEBSITE. I ALWAYS LIKE TO REMIND EVERYONE THAT THE PLACEMENT OF A CONSERVATOR IS A RESULT OF , THAT PUTS INTO THE CONSERVATOR DOMAIN THE ABILITY TO DIRECT, APPROVE OR DISAPPROVE
[01:10:01]
PRINCIPLE SUPERINTENDENT AND REPORT ACTION. OUR CONVERSATION TODAY IS ABOUT THE DESTINATION , THE SAME AS IT HAS ALWAYS BEEN COMPLETING THE CORRECTIVE ACTION PLAN WHICH CONSISTS OF FOUR EXIT CRITERIA, EIGHT GOALS, GPM AND 23 ACTIVITIES. OVERALL, I HAVE TO COMMEND THE BOARD FOR YOUR WORK. THERE IS CONTINUING TO BE PROGRESS. CERTAINLY THERE ARE AREAS I WILL HAVE TO TALK ABOUT LATER THAT INDICATE THERE IS ROOM FOR GREAT IMPROVEMENT. BUT OVERALL THERE HAS BEEN CONTINUING AND ATTENTION TO THE GOVERNANCE OF THIS DISTRICT AND I APPRECIATE THAT. I'M GOING TO GO THROUGH THIS VERY QUICKLY ESPECIALLY THOSE THAT ARE GPM'S THAT ARE SHOWING SIGNS OF SUCCESS , AS YOU KNOW IN THE REPORT WE TALK ABOUT SOMETHING BEING ON TRACK OR OFF-TRACK THAT'S WHY THE IMAGERY OF THE TRAIN. SO GPM 1.1 IS SETTING EXPECTATIONS FOR CONDUCTING MEETINGS. BASICALLY THIS IS ON TRACK , THE QUORUMS OF THE BOARD ARE PRESENT. AGENDAS ARE FOLLOWED, THE CONSENT AGENDA IS COMPLETED AS IT SHOULD BE. QUESTIONING METHODS ARE APPROPRIATE . IN JANUARY THE WORK SESSION WAS COMPLETED WITHIN ONE HOUR AND THE REGULAR MEETING WAS COMPLETED WITHIN THREE HOURS. GPM 1.2 REQUIRES COMPLIANCE WITH THE WEAVER FORENSIC AUDIT. HAPPY TO SAY AND REMIND YOU THIS GPM IS COMPLETE. GPM 2.1 REQUIRES THE BOARD TO REFINE GOVERNANCE SKILLS. AGAIN THIS IS ON TRACK SPECIFICALLY ON TRACK BECAUSE LONE STAR GOVERNANCE HAS BEEN SCHEDULED, I KNOW THERE IS RESCHEDULING JUGGLING AROUND WITH THE CALENDAR, BUT THE FACT THAT THIS TRAINING COVERS GPM REQUIREMENTS IN THIS CORRECTIVE ACTION PLAN, I AM CONFIDENT ONCE THE TRAINING IS COMPLETE THAT YOU HAVE ACCOMPLISHED SOME ADDITIONAL GOVERNANCE SKILLS AND YOU WILL BE DEMONSTRATING THOSE. GPM 2.2 REQUIRES IMPROVING TEAMWORK AND PROBLEM SOLVING SKILLS. AGAIN THIS IS AN AREA ON TRACK, ON TRACK SPECIFICALLY BECAUSE TRUSTEES ARE REGULARLY ATTENDING THE MONTHLY GOVERNANCE WORKSHOPS THAT LSG COACH LLOYD IS PROVIDING AND SIX OF THE SEVEN TRUSTEES HAVE ATTENDED ONE-ON-ONE COACHING SESSIONS, SOMETIMES MORE THAN ONE. ANYTIME YOU HAVE AN INDIVIDUAL COACHING THAT'S ALWAYS GOOD BECAUSE YOU GET TO ASK QUESTIONS AND PARTICIPATE WITH A COACH WHO IS KNOWLEDGEABLE ABOUT GOVERNANCE.YOUR SKILL SETS CAN BE POLISHED AND IMPROVED. GPM 3.1 REQUIRES IMPROVING METHODS FOR REQUESTING INFORMATION. I AM PLEASED TO REPORT THAT THIS IS ON TRACK. REQUESTS ARE DOWN FROM AVERAGE OF 83 PER MONTH TO ONLY 13 IN JANUARY 2024.
THIS IS HUGE AND THE REASON IS WHEN ANYTIME REQUESTS ARE MADE TO THE SUPERINTENDENT, THOSE HAVE TO GO OUT TO THE STAFF, THOSE REQUESTS THEN HAVE TO BE DEALT WITH TAKING TIME AWAY FROM STAFF FROM THE IMPORTANT WORK WHICH A STUDENT PERFORMANCE AND STUDENT OUTCOMES. HAPPY TO REPORT WE ARE SEEING LESS OF THAT OUTSIDE OF THE BOARD MEETING REQUEST AND IN ADDITION TO THAT , TRUSTEES ARE USUALLY USING THE REQUEST PORTAL THAT WAS CREATED IN ORDER TO SEND REQUESTS TO THE SUPERINTENDENT AND/OR STAFF. GPM 4.1 REQUIRES RESOLUTION IN THE CHILD NUTRITION AUDIT. WE HEARD EARLIER FROM FINANCE FOLKS THAT THE AUDIT HAS BEEN COMPLETED. I UNDERSTAND WORK IS GOING TO BE DONE , I DID NOT HAVE INFORMATION FROM MY JANUARY REPORT SO ALL OF REPORTING IS THE AUDIT WAS CONDUCTED AND THERE WILL BE ANOTHER REPORT WITH MORE INFORMATION IN FEBRUARY. GPM 4.2 REQUIRES DISTRICT TO ADDRESS AND RESOLVE SPECIAL EDUCATION COMPLAINTS AND HAPPY TO SAY THESE ARE ON TRACK WITH PAST COMPLAINTS RESOLVE, NEW COMPLAINTS ADDRESSED IN A TIMELY MANNER. NOW LET'S TALK ABOUT GPM 3.2. THIS PARTICULAR GPM IS ABOUT TRUSTEES CONSISTENTLY DEMONSTRATING THE ABILITY TO UPHOLD AND ABIDE BY THE BOARD
[01:15:02]
ETHICS POLICY, RULES OF ORDER AS DESCRIBED IN YOUR OPERATING PROCEDURES. YOU WILL CALL THIS DISTRICT WAS ASSIGNED CONSERVATOR TO WORK WITH THE DISTRICT TO ENSURE POTENTIAL MISSTEPS DID NOT OCCUR TO ASSIST THE BOARD IN WORKING AS A TEAM IN THE BEST INTEREST OF LANCASTER ISD STUDENTS.UNFORTUNATELY THERE CONTINUES TO BE DISCORD AT CERTAIN LEVELS AMONG BOARD MEMBERS, FOR EXAMPLE THE DISCORD INCLUDES SOMETIMES THE WILL OF THE BOARD OPPOSED. BY THAT I MEAN AFTER VOTE IS TAKEN AN AFFIRMATIVE VOTE WAS TAKEN SOME BOARD MEMBERS OR TRUSTEES REFUSED TO ACCEPT THE DECISION OF THE BOARD AND CONTINUE TO QUESTION THE DECISION.
GRIEVANCES HAVE BEEN FILED, CENTERS HAVE BEEN LEVIED, COMPLAINTS HAVE BEEN FILED, LAWSUITS HAVE BEEN FILED. EACH OF THESE ACTIONS IS PROBLEMATIC ON SEVERAL LEVELS. FIRST THE EXAMPLES OF THE INABILITY OF SOME TRUSTEES TO RESOLVE DISAGREEMENTS BETWEEN AND AMONG THEMSELVES. REMOVAL OF CONSERVATOR IS CONTINGENT UPON TRUSTEES IMPROVING INTERPERSONAL RELATIONS. THESE ACTIONS INDICATE CONTINUED OVERSIGHT IS NEEDED IN THIS AREA. BECAUSE SOME TRUSTEES REPEATEDLY ASKED FOR OPINIONS OR INFORMATION FROM THE BOARD ATTORNEY AND A TRUSTEE HAS ACTUALLY FILED A LAWSUIT AGAINST THE TRUSTEE, SUPERINTENDENT AND THE DISTRICT, LEGAL FEES HAVE MOUNTED. NOW THE LEGAL FEES ARE UNAVOIDABLE IN ALL SCHOOL DISTRICTS. THESE UNRELATED TO THE BOARD GOES TO OVERCOME STUDENT OUTCOMES AND PRECIPITATED BY TRUSTEE ACTIONS, THESE FEES ARE NOT ACCEPTABLE. THEY AFFECT THE DISTRICT 1ST RATING AND BECAUSE THEY ARE AVOIDABLE OR PRESENT A LEVEL OF FISCAL IRRESPONSIBILITY. NOT AS EGREGIOUS AS THE PREVIOUS BOARD ACTIONS THAT REQUIRED PLACEMENT OF CONSERVATOR , THERE IS STILL A CONCERN WHICH IS WHY I REQUESTED THE BOARD ATTORNEY PROVIDE ME WITH A REPORT ON YEAR-TO-DATE LEGAL FEES WHICH ARE LISTED ON THIS SLIDE BY TRUSTEE DISTRICT. AS YOU CAN SEE THESE LEGAL FEES ARE QUITE A BIT. NOW ALTHOUGH MUCH OF THE CORRECTIVE ACTION PLAN SHOWS LISD BOARD TO BE ON TRACK TO MEETING GOALS THERE IS MUCH WORK TO BE DONE. HIRED TO TRUSTEES TO CONTINUE WORKING TO DEMONSTRATE GOVERNANCE MATURITY AND DECORUM AND TO FOCUS ON STUDENT OUTCOMES.
WHEN YOU'RE FOCUSED ON STUDENT OUTCOMES AS OPPOSED TO BICKERING AMONG YOURSELVES AND LOVING LAWSUITS, YOU'RE GOING TO DO THE WORK OF THE DISTRICT. SO I THINK YOU. IF THERE ARE ANY QUESTIONS, IF NOT I TURN IT BACK OVER TO OUR
BOARD, BOARD PRESIDENT. >> THANK YOU, ANY QUESTIONS,
COMMENTS FOR DR. -- >> MISS MORRIS?
>> THANK YOU FOR ADDRESSING THE ISSUE WITH THE LEGAL FEES. WE HAVE A DUTY TO UPHOLD TO OUR DISTRICT AND OUR STUDENTS.
SOMEWHERE DOWN THE LINE WE GOT OFF TRACK. IT HAS TAKEN FROM THE STUDENTS TO THE PERSONAL, TO THE PERSONAL. AND I HAVE TO SAY THAT BECAUSE I WANTED TO SAY WHAT I SAID EARLIER, TO THAT THE BOARD AND MADAM PRESIDENT KNOW HOW I APPRECIATE WHAT HAD HAPPENED BUT, MONTHS AGO. MAY BE ONE MONTH AGO. SHE SAID MISS MORRIS, I READ WHAT I READ. NOT ONLY IS OUR DISTRICT SPENDING MONEY, BUT I WANTED TO BE PUBLICLY KNOWN THAT I AM ON THE DOCKET TO BE HEARD BY A GRAND JURY ON AN ASSAULT CHARGE WITH THE INTENT OF JUST OUR DISTRICT TAKING AWAY FROM OUR CHILDREN WE ARE DESTROYING EACH OTHER. WE CAN COME TOGETHER, LOVE TOGETHER, WORK TOGETHER GO HOME AND WE DON'T HAVE TO GO HOME WITH EACH OTHER. WE NEED TO THINK ABOUT WHAT WE ARE DOING TO OUR SUPERINTENDENT WHO CAME HERE OUT OF THIS STAGE, WE HAVE THE CONSERVATOR AND I'M GLAD YOU ARE HERE . I'M GLAD YOU ARE BRINGING UP AND PUTTING IT IN OUR FACE, HOW WE CAN COME BACK
[01:20:03]
AND DO WHAT WE ARE ELECTED TO DO. NOT ATTACK EACH OTHER, BUT ACTUALLY BE HERE SERVING CHILDREN OF THIS DISTRICT.AND THE FIGHT GOES ON. I WANT TO THANK ALL THE CONSTABLES AND ALL THE INSTRUCTORS AND ADMINISTRATION FOR WHAT THEY
DO. THANK YOU, MA'AM. >> MISS WHITFIELD.
>> THE ISSUES STATED BY THE CONSERVATOR AND THE LEGAL FEES ARE OUT OF ORDER. HOWEVER, THIS HAS COME ABOUT DUE TO ALL STARTING WITH ME REQUESTING DOCUMENTS, JUST REQUESTING DOCUMENTS I HAVE YET TO RECEIVE. HOWEVER , WITH THE DISAGREEMENT OF A REPORT THAT I SUBMITTED, TURNING TO ME THAT LED TO AN ILLEGAL BASICALLY CENSURE THAT LED TO LEGAL FEES, YOU CANNOT CREATE AN ISSUE AND THEN YOU KNOW, AND THEN PLAY VICTIM TO YOUR OWN DEMISE. BECAUSE YOU DON'T EXPECT ANYTHING TO TAKE PLACE IN RETURN. NO RETALIATION ON MY PART I CAME IN TO DO MY JOB AND THAT'S THAT I WENT TO THE CONSERVATOR AND TALKED TO HER, I SUBMITTED DOCUMENTS, I CONTINUE TO SUBMIT DOCUMENTS AND INFORMATION SHE REFUSED TO PAY ANY ATTENTION TO. I HAVE ALSO STATED CONFLICT OF INTEREST HAS BEEN CREATED AMONGST THE BOARD AND EXPRESS OTHER CONCERTS REGARDING CONTRACTS.
>> MISS WHITFIELD CAN YOU MAKE SURE YOU REMAIN ON TOPIC ABOUT
THE CONSERVATOR REPORT. >> I AM REMAINING ON TOPIC THE STOP INTERRUPTING ME. THIS IS ONE OF OUR PROBLEMS. WHEN I SPEAK IT IS A PROBLEM, YOU MAY NOT LIKE IT BUT PLEASE RESPECT THAT I HAVE THE FLOOR AND THE CONSERVATOR HAS CONTINUED TO IGNORE. THIS COULD OF BEEN RESOLVED A LONG TIME AGO IF WE WOULD'VE STAYED ON TASK FOR THE CONSERVATOR COMING IN WITH NO CONFLICT OF INTEREST TAKING PLACE. THAT DID NOT TAKE PLACE AND NOW WE ARE HERE AND NOW I GUESS I'M SUPPOSED TO BE --
>> OKAY TIME PLEASE. ANY OTHER COMMENTS ? OKAY HEARING ON,
[13.B. Update board legal fees & reporting]
THANK YOU FOR YOUR REPORT. >> OKAY NEXT ITEM UNDER BOARD MATTERS IS UPDATE BOARD LEGAL FEES AND REPORTING. THIS IS UP FOR DISCUSSION BASED ON WHAT YOU HAVE HEARD FROM AS WELL AS THE SLIDE PRESENTED WITH THE FEES THAT HAVE INCURRED FROM THE BOARD ALONE. THIS IS A MATTER THAT DR. PERERA HAS MENTIONED IS THAT THESE COSTS ARE AFFECTING ADMINISTRATIVE COSTS WHICH WILL REFLECT OUR FIRST RATING. CRILLY WE HAD A A RATING FOR THE LAST FEW YEARS AND WE WOULD LIKE TO MAINTAIN THAT AND I WOULD LIKE TO AS THE BOARD TO PLEASE BE COGNIZANT OF REQUESTS AND THINGS , MAKE SURE WHAT YOU'RE ASKING FOR IS NECESSARY AND THERE IS NO OTHER RESOLVE THAT IS YOUR LAST OPTION. I WOULD ALSO LIKE TO RECOMMEND TO THE BOARD THAT WE CONTINUE TO GET A REPORT EACH MONTH AS TO THE BOARD ON WHAT WE ARE CONTRIBUTING TO THE ADMINISTRATIVE COST THAT COULD JEOPARDIZE THE FIRST RATING NEXT JANUARY WHEN THAT IS PRESENTED TO US. I WOULD LIKE TO MAKE A MOTION TO THE BOARD ASKING THAT WE REQUEST THIS REPORT FROM DR. PERERA AND HER STAFF MONTHLY GOING FORWARD SO WE CAN STAY INFORMED AS TO WHETHER REPORTS AND THE FEES LOOK LIKE FROM THE BOARD TO ENSURE WE ARE DOING OUR DUTY TO THE DISTRICT. OKAY I MADE A MOTION MR. CLEWIS IS THERE A
SECOND? >> SECOND BY MR. SMITH. AT THIS TIME I CAN ASK FOR COMMENTS OR DISCUSSION. I MADE A MOTION.
SO NOW IT HAS BEEN SECONDED, NOW THERE IS ROOM FOR DISCUSSION. MR. CLEWIS HAD THE FLOOR.
>> MY QUESTION WOULD BE WHAT FORMAT WILL THIS REPORT LOOK LIKE? IF YOU'RE GOING TO PROVIDE A REPORT THEN PROVIDE
[01:25:01]
A REPORT, SHOW ME A DETAILED SUMMARY OF HOW WE GOT TO $235 OR THE OTHER DOLLAR AMOUNTS. CAN WE BREAK DOWN THE REPORT? REQUEST GIVEN TO DR. PERERA IF WE VOTE AND PASS FELL FREE TO SEND ADMINISTRATION EMAIL OR REQUEST SAYING THIS IS WHAT IWOULD LIKE TO SEE. >> CAN WE NOT HAVE THAT IN THIS MOTION NOW WHERE IT IS NOTED NOW THAT WE WANT WELL AT LEAST I AM ASKING THAT IT BE A DETAILED REPORT.
>> I CAN AMEND AND THEN ADD DETAILED REPORT. DR.PERERA
>> A DETAILED REPORT WITHOUT CREATING NEW DOCUMENTS WOULD BE THE SUMMARY THAT WE RECEIVED FROM THE LAW FIRM. SUMMARIZING EACH PERSON'S AMOUNT. UNDERSTAND? THEY GIVE US THE ITEMIZED LIST PER COST. SO IN THAT HAS WHO OR WHAT THEY HAVE ADDRESSED FROM THE OFFICE WHICH COMES IN DETAIL. ANY PERSONAL ITEMS OR NAMES, KIDS, ET CETERA I WOULD OMIT .
>> CAN WE MAKE THAT HAPPEN FOR THIS REPORT TODAY?
>> I DON'T HAVE IT WITH ME RIGHT NOW BUT I CONTINUE, THE LAST ONE, ALWAYS KNOW THAT THEY ARE A MONTH BEHIND BECAUSE WE ARE RECONCILING BEFORE WE PASS. ABSOLUTELY I CAN INCLUDE THOSE. THAT WOULD JUST NEED TO KNOW I WILL REDACT NAMES TO PROTECT PRIVACY OF INDIVIDUALS ET CETERA BECAUSE THEY ALSO DEAL WITH PERSONNEL ITEMS.
IT DOES NOT STATE IT HERE? >> YES IT CAN.
>> YES, THE NUMBERS ARE A LITTLE SHOCKING. LOOKING AT 10,000 SOMETHING FOR DISTRICT 2 WHEN I REMEMBER WHEN REQUESTING HOW MUCH WE SPEND ON THE GRANGER EFFORT OVER A COUPLE YEARS WAS $17,000. SUCH A SHORT PERIOD OF TIME IT DOES NOT ADD UP. SIMILAR TO MR. CLEWIS I WOULD LIKE A DETAILED EXPLANATION OF WHERE THE EXPENSES ARE AND EXACTLY WHAT THEY ARE FOR. IT IS NOT HELPFUL TO HAVE RUN NUMBER AND SAY YOU WERE CHARGED THIS MONTH.
>> OKAY ANY OTHER CONVERSATION? COMMENTS? IS ON THERE STATING I AM RACKING OF THE CHARGES I AM NOT , IT IS THE BOARD MEMBERS WHO CONTINUE TO FIGHT , FIGHTING SOMETHING THEY STARTED. TO THOSE CHARGES ACTUALLY BELONG TO YOU GUYS AND NOT ME BECAUSE I'M NOT THE ONE UTILIZING THE DISTRICT ATTORNEY YOU KNOW AS MY TO GO NOR HAVE I UTILIZED HIM. THAT IS THE BOARD MEMBERS THAT ARE UTILIZING THE DISTRICT ATTORNEY AT THEIR WILL AT THEIR DISCRETION WITHOUT EVEN DISCUSSION WITH THE BOARD AS IT RELATES TO A SITUATION CAUSED BY THE BOARD. SO THOSE ARE NOT MY FEES ,
THOSE ARE YOURS. >> OKAY THANK YOU. THERE WAS A REQUEST . MR. JONES GO AHEAD.
>> I KNOW THIS ITEM SPEAKS OF BOARD LEGAL FEES AND REPORTING, ONE OTHER THING I WOULD LIKE TO ADD FOR DISCUSSION FOR POTENTIAL APPROVAL LOOKING AT THE FEES FOR BOARD AND LEVEL OF TRANSPARENCY THAT WE ALSO INCLUDE TRAVEL BUDGETS SO WE HAVE A CERTAIN AMOUNT PER YEAR AND THAT CAN BE DOCUMENTED. I KNOW WE GET REPORTS ON A MONTH OR TWO MONTH BASIS SO THAT CAN BE PUBLISHED EITHER TO THE BOARD MEETING OR ON THE WEBSITE , THAT WOULD BE SUFFICIENT WITH TRANSPARENCY THAT WE ARE BEING GREAT STEWARDS OF THE TAXPAYER DOLLARS AND BUILDING CAPACITY TO THE DISTRICT GOING THROUGH CERTAIN TRAININGS AND PRESENTING OR WHAT HAVE YOU. THAT CONCLUDES MY STATEMENT.
>> OKAY I HAVE HEARD THE AMENDMENT NEEDS TO BE , THE MOTION NEEDS TO BE AMENDED. I AM PRIVILEGED TO DO FRIENDLY AMENDMENT OF MY MOTION. I WILL AMEND THE MOTION TO READ WE ARE REQUESTING TO OBTAIN BOARD LEGAL FEE MONTHLY IN A DETAILED
[01:30:02]
ITEMIZED REPORT SO THAT IT WILL BE CLEARLY READ AND MR. JONES HAS REQUESTED FOR THE TRAVEL BUDGET TO BE PUBLISHED MONTHLY ALSO. IS THERE A SECOND?>> SECOND. >> SECOND BY MR. CLEWIS ANY OTHER DISCUSSION? MISS MORRIS?
>> I HAVE ONE BECAUSE DR.PERERA RAISED A GOOD QUESTION. ARE LOOKING AT OUR RESPONSIBILITY OF DUTIES OR DR.PERERA BECAUSE WE HAVE NO CONTROL OVER THE GRIEVANCE FILED BY EMPLOYEES. AND I DON'T THINK WE SHOULD SEE THIS INFORMATION BEFORE THOSE GRIEVANCES IN CASE THEY GET OUR LEVEL. SO I WANT TO BE KIND OF CLEAR I UNDERSTAND THAT CORRECT. ARE WE ASKING ABOUT EVERYTHING INCLUDING EMPLOYEES? REFERENCE TO BOARD MEMBER LEGAL FEES AND SPENDING AS WELL AS
BOARD MEMBER TRAVEL ONLY. >> THANK YOU.
>> ANY OTHER COMMENTS OR QUESTIONS. HEARING ON I WILL CALL FOR THE VOTE.
[13.C. Consideration and possible approval of the Board Resolution in Support of a Fair and Transparent Accountability System - (Resolution will be read by Board President Marion Hamilton.)]
SO MUCH. CONSIDERATION AND POSSIBLE APPROVAL OF THE BOARD RESOLUTION SUPPORT OF A FAIR AND TRANSPARENT ACCOUNTABILITY SYSTEM. I DON'T THINK HAVE THE RESOLUTION HERE.RESOLUTION INTO THE RECORD. BOARD RESOLUTION SUPPORT OF A FAIR AND TRANSPARENT ACCOUNTABILITY SYSTEM WHEREAS DISTRICT BOARD SCHOOL OF TRUSTEES BELIEVES IN A FAIRLY AND CONSISTENTLY APPLIED ACCOUNTABILITY RATING YEAR-TO-YEAR WHEREAS LANCASTER ISD BOARD OF TRUSTEES ACKNOWLEDGES THE RATING SYSTEM SHOULD PROVIDE TRANSPARENCY TO PARENTS AND THE PUBLIC WAS SIMPLE AND UNDERSTANDABLE INFORMATION. WHEREAS THE TRANSPARENCY OBJECTIVE IS ALSO FURTHERED BY REQUIRING THE COMMISSION TO PROVIDE THE MEASURES METHOD AND PROCEDURES TO SCHOOL DISTRICTS THAT WILL BE APPLIED TO SCHOOL DISTRICTS YEAR-TO-YEAR AND WITHOUT MEDIA CHANGE. WHEREAS YEAR-TO-YEAR CONSISTENCY ALLOWS TIMELY NOTICE TO SCHOOL DISTRICTS AND CAMPUSES TO PLAN SCHOOL IMPROVEMENT EFFORTS BASED ON MEASURES METHODS AND PROCEDURES ADOPTED BY THE COMMISSION. WHEREAS THE LEGISLATOR REQUIRES COMMISSIONER TO PROVIDE THE MEASURES METHODS AND PROCEDURES ON A YEARLY BASIS WITHOUT CHANGE WITHOUT ANNUAL CONSISTENCY SCHOOL DISTRICTS AND CAMPUSES CANNOT EFFECTIVELY PLAN TO ACHIEVE HIGH PERFORMANCE RATINGS UNLESS THE COMMISSIONER COMPLIES WITH LEGISLATOR MANDATE. THEREFORE BE RESOLVED THE LANCASTER ISD BOARD OF TRUSTEES JOINS IN A COLLECTIVE EFFORT WITH STATE , TEXAS STATE BOARD TO COMMIT SUPPORT IN PURSUING ACTION TO ENSURE THE RATING SYSTEM PROVIDES A FAIR TRANSPARENT AND EFFECTIVE SYSTEM FOR ASSIGNING PERFORMANCE RATINGS TO SCHOOL DISTRICTS BASED ON CONSISTENT MEASURES METHODS AND PROCEDURES. OPPOSE THE RETROACTIVE AND MEDIA CHANGES TO THE MEASURES METHODS AND PROCEDURES USED FOR THE 2022-2023 SCHOOL YEAR PERFORMANCE RATINGS. STAND IN SUPPORT OF THE RATING SYSTEM INHERENT TO TEXAS STATE LAW PASSED BY THE TEXAS LEGISLATOR.
STAND IN SUPPORT OF EFFORTS TO REFRAIN ACCOUNTABILITY RATING SYSTEM TO ONE THAT USES MULTIPLE EFFECTIVE SCHOOL MEASURES FOR ALL GRADE LEVELS IN A MORE HOLISTIC APPROACH TO SIGNING THE RATINGS OF A CAMPUS AND PERFORMANCE OF EACH STUDENT IN LIEU OF RELYING HEAVILY ON THE STANDARDIZED TESTING. PASS AND APPROVE ON THE 22ND DAY OF FEBRUARY AND IT WILL BE SIGNED BY MYSELF PRESIDENT , MR. JONES VICE PRESIDENT AND SECRETARY MORRIS. OKAY BOARD THIS DOES REQUIRE
ACTION. IS THERE A MOTION? >> I MOTION THAT WE ACCEPT THE
RESOLUTION AS STATED. >> MOTION BY MR. SMITH TO ACCEPT RESOLUTION AS STATED, SECOND I MISS MORRIS, DISCUSSION FROM THE BOARD? HEARING ON I WILL CALL FOR THE VOTE.
[13.D. Consideration and possible action on grievance concerning board censure of Trustee Gregory Stephenson on November 16, 2023.]
BOARD MET A CONSIDERATION AND POSSIBLE ACTION ON GRIEVANCE CONCERNING EXCUSE ME. CONSIDERATION AND POSSIBLE ACTION ON GRIEVANCE CONCERNING BOARD CENTER OF TRUSTEE GREGORY STEVENSON ON NOVEMBER 16TH, 2023. COMMISSIONER[01:35:03]
STEPHENSON WOULD YOU LIKE THIS TO BE HELD IN OPEN OR CLOSED>> REQUESTING TO BE HELD IN OPEN SESSION. WILL YOU TAKE
THIS FROM HERE? >> YES. THIS IS, THE HEARING AT THE LAST COURT MEETING ON THE 25TH OF JANUARY BEFORE TODAY CONCERNING ONE OF THE GRIEVANCES FROM TRUSTEE STEPHENSON AND THIS IS THE ONE INVOLVING HIS CENTER ON NOVEMBER 16TH. SO, GENERALLY WE AUTHORIZE 10 MINUTES PER SIDE FOR THESE . I WILL GIVE YOU MORNING IF YOU WANT TO
SPLIT YOUR TIME. >> GIVE ME A WARNING AT FIVE
MINUTES PLEASE. >> FIVE MINUTES YES SIR.
YES I WILL GIVE YOU A WARNING AT FIVE. START WHEN READY. SO THANK YOU, FIRST LET ME THANK MY COLLEAGUES FOR ALLOWING ME TO SPEAK TO THE. THIS CENTER AND REVEREND IS WRONG AND UNFAIR AND ILLEGAL. SCHOOL BOARD TRUSTEES HAVE IMMUNITY FROM CIVIL LIABILITY. TEXAS EDUCATION CODE SECTION 22.051 DEFINES A PROFESSIONAL EMPLOYEE OF THE DISTRICT INCLUDES NUMBER FIVE A MEMBER OF THE BOARD OF TRUSTEES. 22.0511 SUBPARAGRAPH PROFESSIONAL EMPLOYEE OF A SCHOOL DISTRICT IS NOT PERSONALLY LIABLE FOR ANY ACT INCIDENT TO OR WITHIN THE SCOPE OF THE DUTIES OF THE EMPLOYEE POSITION OF EMPLOYMENT AND THAT INVOLVES EXERCISING JUDGMENT OR DISCRETION ON PART OF THE EMPLOYEE. EVERY ACTUAL CONVERSATION I HAVE ABOUT THE LANCASTER ISD IS A MATTER OF PROFESSIONAL BUSINESS AND WITHIN THE SCOPE AND INCIDENT OF THE DUTIES OF MY POSITION THEREFORE UNDER THE STATUTE I AM FOR POSSIBLE I'LL BUY A CHILLY . THE STATURE SHOULD BE LED REALLY WITH WORDS GIVEN THEIR PLAIN MEANING DO NOT OVERTHINK IT. TRUTH AND JUSTICE BE YOUR GUIDE. LET'S TURN TO THE ISSUE OF CENSURE . I PASSIONATELY BELIEVE THE CENTER IS AN ABOMINATION AND EGREGIOUS AFFRONT TO THE FREE SPEECH WE ARE GUARANTEED UNDER THE FIRST AMENDMENT. FREE SPEECH THAT WE CHERISH AS A BIRTHRIGHT AND IN THIS REGARD , IN 2013 DAVID WILSON WAS ELECTED TO THE BOARD OF TRUSTEES OF THE HOUSTON COMMUNITY COLLEGE SYSTEM. THE PUBLIC ENTITY THAT OPERATES VARIOUS COMMUNITY COLLEGES. MR. WILSON OFTEN DISAGREE WITH THE BOARD ABOUT BEST INTEREST AND HE BROUGHT MULTIPLE LAWSUITS CHALLENGING THE BOARD ACTIONS. BY 2016 THESE ESCALATING DISAGREEMENTS LED THE BOARD TO REPRIMAND MR. WILSON PUBLICLY. MR. WILSON CONTINUED TO CHARGE THE BOARD IN MEDIA OUTLETS AND STATE COURT ACTION WITH VIOLATING ETHICAL RULES AND BYLAWS. SOUND FAMILIAR? ULTIMATELY THE COLLEGE CENSURED MR. WILSON AND IMPOSED SANCTIONS MR. WILSON SUED CLAIMING FIRST AMENDMENT RIGHTS WERE VIOLATED. AFTER SEVERAL ACRIMONIOUS YEARS THE CASE WENT TO THE FIFTH CIRCUIT WHERE MR. WILSON PREVAILED AND THE SUPREME COURT IN THIS CASE WAS A UNANIMOUS VERDICT . STILL WITH ME? BY NOW YOU PROBABLY WONDER HOW THIS HELPS MY CASE SINCE I DISAGREE WITH THE CENSURE. THIS IS HOW THIS MAKES MY CASE. THE COURT MAINTAINED THE BOARD CENSURE WAS FIRST AMENDMENT PROTECTED SPEECH AS WAS MR. WILSON . THEREFORE NOT IN VIOLATION FOR THE FIRST AMENDMENT IN AND OF ITSELF , IN OUR CASE IS NARROW AND ABOVE THE CENTER OF A NUMBER OF AN ELECTED BODY BY OTHER MEMBERS OF THE SAME BODY. IT DOES NOT INVOLVE EXPULSION EXCLUSION OR ANY OTHER FORM OF PUNISHMENT. THAT'S KEY, THE DIFFERENCE BETWEEN FIRST AMENDMENT OF A BOARD CENSURE AND THE FIRST AMENDMENT OF A BOARD MEMBER , BUT NOT SANCTIONS AND PUNISHMENTS. THIS CASE ONLY DECIDES THE CENTER, IT ONLY STATES A CENSURE WITH THE SANCTIONS AND OTHER PUNISHMENTS IS NOT VIOLATION OF THE FIRST AMENDMENT. ALSO WROTE WHEN THEY RESPONDED IN THE COURT SEEKS TO ALTER A LOWER COURT JUDGMENT HE MUST FILE AND WE MUST GRANT CROSS IN THE CASE MR. WILSON FILED NO SUCH PETITION IN THE CASE AND THAT'S WHY THE COURT DID NOT RULE ON THE PUNISHMENT ATTACHED TO HIS SANCTIONS, THE ONLY RULED ON THE FIRST AMENDMENT CLAIM ITSELF. A NON-PUNISHMENT CENTER IS THE FIRST AMENDMENT BETWEEN TWO PARTNERS. A CENSURE THAT ANNEX SANCTIONS AND PUNISHMENTS HOWEVER IS NOT ALLOWED UNDER THE FIRST AMENDMENT. ONLY MR. WILSON'S FAILURE TO FILE ACROSS PREVENTED THIS FROM
[01:40:05]
BECOMING FURTHER IN HIS DECISION. I'M NOT A FAN OF THIS COURT, ANY DECISION GETS A RESOUNDING 9-0 BUT CANNOT BE IGNORED OR CRITICIZED. THE DECISION THE SUPREME COURT ARE THE LAW OF THE LAND AND IT IS THE AUTHORITY. TO BE HONORED BY RANGER STATION FROM SEA TO SHINING SEA INCLUDING THIS BOARD OF TRUSTEES. YOU MAY CENSURE BUT WHEN YOU HAVE PENALTIES AND SANCTIONS AND BECOMES VIOLATION OF THE FIRST AMENDMENT AND IT IS THEREFORE ILLEGAL. IS A PROUD VETERAN OF THE UNITED STATES ARMY SWORE TO PROTECT AND DEFEND THE CONSTITUTION I ACCEPT THE PRONOUNCEMENT OF THE SUPREME COURT. I REJECT THESE OUTRAGEOUS SANCTIONS. NOW TO THE SPECIFICS OF THE CENSURE /REPRIMAND. THIS DOCUMENT COMPLAINTS CENTER AND GOVERNMENT AND STATES THE BOARD LOCAL POLICY AUTHORIZES CENSURE AND REPRIMAND AND IT DOES NOT.BOARD POLICY DOES NOT MENTION CENSURE. THE FACT IS THE UNITED STATES OF AMERICA OVER TWO AND HALF CENTURIES AGO BORN DESIGNED TO BE SOMETHING NEW IN THE CONSTITUTION THERE IS NO MENTION OF A CENSURE AND IN STATURES THERE IS NO MENTION OF
A CENSURE. CENTER REPRESENTS. >> IT HAS BEEN FIVE MINUTES.
>> THANK YOU. >> SORRY I DID NOT MEAN TO
INTERRUPT, YOU CAN PROCEED. >> THE CENTER REPRESENTS TOOL USED IN THE TYRANNY OF THE MAJORITY WHEN NOTHING THE LAW SUPPORTS THE PUNISH THEY WISH TO INFLICT ON PEOPLE. IT IS THE SITE, THE MAJORITY USES TO PUNISH PEOPLE THAT THEY DO NOT LIKE IN FACT THE CLEAREST REASON THERE IS NO LAW TO SUPPORT WHAT THEY WANT TO DO IS THAT IN CASE OF A SCHOOL BOARD OF TRUSTEES IN THE STATE OF TEXAS WE ARE IMMUNE DURING THE COURSE TO PERFORM DUTIES AS TRUSTEES. AGENCY VERSUS WILSON 2022, THE PARTY SUPPLIED LITTLE REASON TO THINK THE FIRST AMENDMENT WAS DESIGNED OR COMMONLY UNDERSTOOD TO A FAMILY PRACTICE OF CENSURE. I WOULD COUNTER THE EVIDENCE TO THE CONTRARY IS LIKE THE CONCEPT OF JUDICIAL REVIEW CENSURE WAS NOT INCLUDED IN THE CONSTITUTION. JUSTICE WENT TO EXPLAIN BEGINNING IN 1811 IN THE SENATE FROM THE EARLIEST DAYS OF THE REPUBLIC THE MAJORITY WAS SEEKING TO DO BY CENSURE WHAT THEY CANNOT DO BY CONSTITUTION STATUTE OR FORCE OF LAW IN THIS CASE THEY SEEK TO DO WITH THE CAN I DO BY CONSTITUTION STATUTE POLICY OR PROCEDURE. THE CENSURE DOCUMENT ALSO REFERENCES THE CONCEPT OF REPRIMAND BY LOCAL BOARD POLICY. THE ETHICS POLICY LISTS A NUMBER OF ISSUES THE CENTER DOCUMENT NEVER INDICATES WHO GETS TO DETERMINE WHAT CONSTITUTES VIOLATION OF A REPRIMAND WILL ISSUE NEITHER DOES THE CENSURE DOCUMENT INDICATE WHAT IN THE DOCUMENT IS BEING CENSURED AND WHAT IS ALLEGEDLY A VIOLATION OF ETHICS. THEREFORE FOR THE POLICY THE VAGUENESS IS NOT ENFORCEABLE . ADDITIONALLY, SEPTEMBER 17, 2018 THE DISTRICT MOVED TO POLICY SERVICE THE CONTRACT SIGNED BY THEN SUPERINTENDENT GRANGER. AT THIS TIME THE DISTRICT OUTSOURCED THIS ONLINE POLICY SERVICE AND DISCONTINUE THE HARD COPY OF THE POLICY MANAGEMENT. AT THIS TIME THE ADMINISTRATION BECAME ABLE TO CHANGE POLICIES ONLINE WITHOUT KNOWLEDGE OF THE BOARD OF TRUSTEES. THERE IS EVIDENCE LOCAL WAS CHANGED IN 2023 WITHOUT A VOTE OF THE BOARD AND IN ADDITION THERE IS NO EVIDENCE THE ONLINE POLICIES WAS EVER VOTED ON BY THE BOARD OF TRUSTEES. BOARD POLICY ALSO REQUIRES ADMINISTRATION TO KEEP A HARD COPY OF THE POLICY WITH AN UPDATED AND AVAILABLE INSPECTION. IT IS NOT. GIVEN THAT THE BOARD NEVER VOTED TO ACCEPT ONLINE POLICY NOR CAN ALL CHANGES BE VERIFIED THESE ONLINE POLICIES ARE ENFORCEABLE. I COULD GO THROUGH WITH EACH AREA UNDER SETTINGS HOWEVER THAT WOULD BE A WASTE OF TIME. NONE OF THE STATUTES ARE IMMUNE FROM ANY LIABILITY OR ANYTHING IN THE CENSURE DOCUMENT. I ACCEPT THE CENTER ITSELF IS A FIRST AMENDMENT RIGHT OF THE BOARD OF TRUSTEES AS IS MY COMMUNICATIONS AND ACTIONS DURING THE COURSE OF MY SERVICE HOWEVER THE ATTACHED SANCTIONS VIOLATE MY FIRST AMENDMENT RIGHTS AND MUST BE SET ASIDE. I THINK YOU FOR YOUR TIME. I WON'T TAKE ANY MORE THAN NECESSARY. APPRECIATE YOU LISTENING TO ME AND THAT INCLUDES MY REMARKS.
>> THANK YOU. >> DO YOU HAVE A RESPONSE? OR NOT? A COUPLE OF THINGS. WITH RESPECT TO YOUR ARGUMENT, WITH
[01:45:01]
RESPECT TO THE 22.0511 , WITH RESPECT TO COMMUNITY, ON ITS FACE IT DOES NOT APPLY TO THE TRUSTEES . NOT TO SAY TRUSTEES DON'T HAVE A FORM OF IMMUNITY, THEY DO IT IS CALLED GOVERNMENTAL IMMUNITY AND RIDES UNDER THE CONSTITUTION SPECIFICALLY WITH RESPECT TO THAT STATUTE, THAT STATUTE HAS TO DO A CIVIL LIABILITY WHICH MEANS LIABILITY FOR DAMAGES IN A COURT OF LAW IN A CIVIL CASE AND THAT'S NOT WHAT WE HAVE HERE. SO THAT STATUTE DOES NOT APPLY TO THE CIRCUMSTANCES.THERE IS A FORM OF IMMUNITY. I AGREE WITH YOU THAT I AM AWARE OF THE CASE IN THE SUPREME COURT CASE WITH RESPECT TO THE FIRST AMENDMENT. THE BOARD CENSURE OR REPRIMAND OR WHATEVER YOU WANT TO CALL, THE INTERCHANGEABLE TERMS. MADE A STATEMENT WITH RESPECT TO THEIR BELIEF WITH RESPECT TO YOUR CONDUCT. FULLY ACCEPTABLE FOR YOU TO DISAGREE WITH THAT.
NOT EXPECTING YOU TO. IT IS A STATEMENT OF THE BOARD POSITION WITH RESPECT TO THAT. SO YOUR ARGUMENT WHETHER FAIR OR NOT IS NOT LEGAL, BUT IT IS FACTUAL TO THE BOARD. WHICH I WILL LEAVE TO THEIR DISCRETION. WITH RESPECT TO THE ISSUE OF WHETHER THE SANCTIONS , WHICH ARE LET'S BE CLEAR ABOUT THAT , THAT YOU OBTAINED THREE , THREE , ONE HOUR COURSES IN GOVERNANCE TRAINING IN ONLINE OR IN PERSON AT YOUR DISCRETION IS IT IS NOT OR WAS NOT ADDRESSED IN THE COURT CASE THAT YOU CITED. I DO UNDERSTAND THE COURSE EACH OPINION WITH RESPECT TO THAT , IF THERE WAS ANOTHER SANCTION, BUT THAT'S WHAT IS KNOWN AS , SO THAT WAS NOT AN ISSUE IN THAT CASE SPECIFICALLY. SOLD THE PRECEDENT IS AN BINDING.
IN MY OPINION IF THERE WAS A MONETARY SANCTION OR THINGS OF THAT NATURE, THAT I WOULD MIGHT LOOK AT THIS A LITTLE BIT DIFFERENTLY, BUT YOUR ETHICS POLICY SPECIFICALLY SAYS THAT SANCTIONS CAN BE TAKEN , TRAINING ESPECIALLY IF YOU SAW THE ISSUE WITH RESPECT TO THE CONSERVATOR REPORT SEEMS REASONABLE UNDER THE CIRCUMSTANCES. THERE HAS BEEN NO ENFORCEMENT OF THAT AT THIS POINT , BUT WE HAVE DISCUSSED THAT, THERE WAS A DEADLINE WHICH PASSED FOR THAT TRAINING, BUT SINCE YOU HAD A LEGITIMATE GRIEVANCE ON IT, THERE HAS BEEN NO ENFORCEMENT ON THAT PENDING THE OUTCOME OF THE GRIEVANCE.
SO MY RECOMMENDATION WITH RESPECT TO THAT IS THAT THE BOARD EITHER CONSIDER YOUR ARGUMENT AND CHANGE THAT WHICH THEY HAVE THE PREROGATIVE TO DO OR THEY GRANT YOU AN EXTENSION IN ORDER TO COMPLETE THE TRAINING AT THEIR DISCRETION.
THAT'S ALL I HAVE. YOU HAVE A MINUTE AND A HALF LEFT.
>> LET ME STATE THEN YOU SAID 22.051 DOES NOT APPLY TO TRUSTEES AND THE LETTER OF THE STATUTE ITSELF SAYS , DESCRIBES TRUSTEES. IT SAYS BOARD OF TRUSTEES SO HOW CAN IT NOT APPLY TO TRUSTEES? SO YOU ARE DEFINING CIVIL LIABILITY AS
ONLY A LAWSUIT. >> I AM DEFINING CIVIL LIABILITY AS THE SANCTIONS PLACED UPON MY CIVIL LIABILITY FOR VIOLATING WHAT THEY CALL A CENSURE OR REPRIMAND OR WHATEVER. THAT IS A POINT OF FACT TO BE DECIDED BY THE
BOARD. >> CONSIDERING IT IS NOT SO HOLD AND THE CASE LAW WITH RESPECT TO THAT IN ALL THE CASES THAT HAVE BEEN ARISEN UNDER THAT HAS BEEN THAT IT APPLIES TO CIVIL LIABILITIES.
>> IF YOU'RE GOING TO HOLD A POINT OF LAW LIKE THAT I WOULD RESPECT THE REQUEST YOU PRESENT THE CASE LAW THAT SUPPORTS IT.
EXPAND MORE ATTORNEYS FEES. I AM PERFECTLY WILLING TO DO
THAT. >> BE HERE PUT IT ON THEIR
>> MADAM PRESIDENT WITH THE BOARD HAVE OPPORTUNITY? WHAT
[01:50:01]
THE BOARD WILL HAVE OPPORTUNITY TO DELIBERATE. WOULD YOU LIKE TO DELIBERATE? OPEN HEARING THAT THE BOARD HAS A CHOICE AS TO IF THEY WOULD LIKE TO DELIBERATE IN OPEN OR CLOSED.>> I WOULD LIKE TO MAKE MY STATEMENT WITH THE HEARING BEING IN THE OPEN? SO I'M SORRY, CAN YOU PROVIDE CLARITY? BECAUSE I WAS THE REPRESENTATIVE , THE
DELIBERATION SHOULD BE OPEN. >> THEN WE NEED TO DO IT OPEN.
YOUR COMMENT >> WE SAW THE FEES THAT CONSERVATORS SHOWED US. CAN YOU TELL US SO I WILL BE CLEAR HOW MANY OF THOSE LAWSUITS HAVE BEEN FILED THAT HAD OR HAVE MR. STEPHENSON NAME ON THEM?
>> IN ALL FAIRNESS TO HIM HE HAS DISALLOWED BASICALLY. FAIR ENOUGH YOU FILE A MOTION TO ABATE. WHICH IS CLOSE TO
DISMISSAL. >> EXCUSE ME. THAT QUESTION IS OFF-TOPIC FROM WHAT WE'RE TALKING ABOUT GOING INTO THIS
>> I AGREE IT IS OFF-TOPIC. >> HE IS SAYING THAT WE VOTED, HE IS SUING THE BOARD. I WANTED TO KNOW HOW MANY.
>> THIS IS NOTHING TO DO WITH ANY OF THE LAWSUITS OR LEGAL FEES. WE NEED TO FOCUS ON THE CENSURE. IF WE'RE GOING TO UPHOLD OR OVERTURN IT. THAT IS THE MAIN PURPOSE OF THIS GRIEVANCE. THE BOARD HAS VOTED ON THE CENSURE BACK IN NOVEMBER. COMMISSIONER STEPHENSON STATED HE FEELS IT IS UNFAIR AND IT IS UP TO THIS BOARD TO MAKE A DECISION IF WE UPHOLD THE CENSURE VOTED ON OR IF WE WILL OVERTURN IT.
>> I HAVE A QUESTION FOR THE ATTORNEY.
>> MISS MORRIS STILL HAS COMMENTS, HOLD ON MISS
WHITFIELD. >> NOW WHAT WAS THE CENSURE , DID I UNDERSTAND CORRECT THAT THE ONLY WAS TO TAKE MORE
BOARD TRAINING? >> YES. IT WAS SPECIFICALLY TO TAKE BUILDING EFFECTIVE BOARD SUPERINTENDENT TEAMS ETHICS FOR SCHOOL TRUSTEE AND FOCUS A PROTECTIVE BOARD DISCUSSION. FOR THE THREE LISTED COURSES.
>> IN YOUR OPINION, AS OUR ATTORNEY WHY, OR CAN YOU SPEAK TO THAT ON WHY IT WAS REQUESTED BY THE BOARD TO REQUEST MR. STEPHENSON TO HAVE THAT TRAINING?
>> WELL, BECAUSE SET FORTH IN THE RESOLUTION THE BOARD POLICY AND LOCAL AUTHORIZES BOARD OF TRUSTEES TO IMPOSE CONSEQUENCES INCLUDING A PUBLIC REPRIMAND OR THE ADOPTION OF THE CENSURE RESOLUTION. AND THE BOARD TRAINING IS SOMETHING THAT IS REQUIRED ANYWAY . THE TRUSTEES NEED TO ACQUIRE A CERTAIN AMOUNT OF TRAINING ON A ANNUAL BASIS ANYWAY. THIS SIMPLY DIRECTS IT TO SPECIFIC TOPICS THAT WERE OF INTEREST AND RELEVANT TO THE RESOLUTION. SO IT'S NOT LIKE THE ADDITION OF WHAT WE'RE CALLING REQUIRING HIM TO TAKE A BUNCH OF TRAINING THAT OTHERWISE WOULD NOT BE REQUIRED THERE IS ANNUAL TRAINING REQUIREMENTS FOR ALL TRUSTEES. THIS JUST DIRECTS SPECIFIC TOPICS. IT SEEMS LIKE A RELATIVELY MODEST SANCTION. HE MAY NOT THINK SO AND ULTIMATELY IT WILL BE THE BOARD TRUSTEE DECISION ON, IT'S NOT
MINE WHETHER OR NOT, >> MADAM PRESIDENT MAY I HAVE
A VOICE IN THIS? >> ARE YOU FINISHED SPEAKING?
>> IF I MAY. I WAS ASKED WHO DIRECTED THE CENSURE TO DRAW
OF THE CENSURE? >> YOUR OFF-TOPIC, WE NEED TO
[01:55:03]
FOCUS ON WHAT WE'RE DOING NOT WHO DID THE CENSURE. WE HAD THIS DISCUSSION DURING THE LAST MEETING, THE QUESTION WAS ASKED WHEN WE DID THE CENSURE. ASKED AND ANSWERED.>> THE FLOOR AND I ASK THE ATTORNEY QUESTION. IF YOU CAN PLEASE ALLOW HIM TO ANSWER MY QUESTION I WOULD GREATLY APPRECIATE IT. IT IS NOT OUT OF ORDER. THERE WAS A CENSURE DRAWN AGAINST TRUSTEES AND HE IS ONE OF THOSE TRUSTEES. SO MY QUESTION IS THE DIRECT QUESTION IS WHO DIRECTED HIM
TO DRAW UP THE CENSURE? >> CAN YOU RESPOND THIS IS
OFF-TOPIC FOR THE ITEM? >> CAN ATTORNEY HELEN ANSWER THE QUESTION WITHOUT INTERRUPTION PLEASE? I HAVE THE FLOOR AND I AM ASKING HIM A QUESTION. ATTORNEY IF YOU MAY
PLEASE. >> WHAT'S THE QUESTION AGAIN?
CENSURE? >> WHO DIRECTED THE BOARD PRESIDENT WHEN SHE ASKED FOR AN AGENDA ITEM AND POTENTIAL
ACTION ? >> ALL THE DIRECTORS CAME FROM
THE BOARD PRESIDENT. >> UNDER DISTRICT POLICY, THE BOARD PRESIDENT IS AUTHORIZED TO TASK COUNCIL WITH SPECIFIC RESPONSIBILITIES AS IS THE SUPERINTENDENT.
>> EXCUSE ME. THE ATTORNEY AS WELL AS TRUSTEE WHITFIELD THE ITEMS YOU ARE SPEAKING OF DO NOT HAVE ANYTHING TO DO WITH THE GRIEVANCE SO LET'S GET BACK ON TOPIC REGARDING THOSE
ITEMS. >> THIS WHOLE MEETING IS
BECAUSE OF THE CENTURY. >> RIGHT NOW THIS IS HIS GRIEVANCE AND YOUR QUESTION IS TO PERTAIN TO HIS GRIEVANCE AND STATEMENTS MADE. STATEMENTS MADE BY TRUSTEE STEPHENSON TONIGHT AND/OR THE STATEMENTS MADE BY THE ATTORNEY TONIGHT.
THANK YOU. >> SO MY QUESTION AS IT RELATES TO TRUSTEE LANCASTER ISD IN CONCERNS OF THE GRIEVANCE BEING DRAWN UP AGAINST HIM IS ALL RELATING
TO HIS CENSURE . >> THESE STATEMENTS OR QUESTIONS NEED TO PERTAIN TO HIS STATE AND THIS EVENING AND STATEMENTS BY THE ATTORNEY THIS EVENING. THANK YOU.
>> DO YOU HAVE ANY OTHER QUESTIONS? THAT ARE ON TOPIC?
>> ATTORNEY, PER THE TRUSTEE STATEMENT THAT THE POLICY DOES NOT STATE THAT ANYTHING CAN GO PAST A REPRIMAND , A REPRIMAND , YOU KNOW WHAT . I ALREADY SEE THAT .
>> THE CONSEQUENCE INCLUDES A REPRIMAND.
>> DO NOT INTRO ME IF I DON'T HAVE THE RIGHT TO ASK QUESTIONS. YOU CAN ASK WHATEVER YOU WANT.
>> THE POLICY SAYS CONSEQUENCES INCLUDING A PUBLIC REPRIMAND.
THE POLICY SAYS CONSEQUENCES INCLUDING A PUBLIC REPRIMAND.
ME TO HELP ME UNDERSTAND INCLUDING PUBLIC REPRIMAND? THAT'S PRETTY MUCH MAKING A STATEMENT BUT IT DOES NOT SAY ACTION. I DID NOT SEE ANY ACTIONS AS WELL SO I GUESS I DON'T UNDERSTAND EXACTLY WHAT YOU MEAN.
>> OKAY TRUSTEE WHITFIELD YOUR QUESTIONS ARE NOT PERTAINING TO THE GRIEVANCE OF TRUSTEE STEPHENSON SO WE ARE GOING TO MOVE FORWARD. IF YOU HAVE NO OTHER QUESTIONS PERTAINING TO THE STATEMENTS THAT HAVE BEEN MADE THIS EVENING BY TRUSTEE STEVENSON. AND/OR THE ATTORNEY . OF THOSE QUESTIONS ARE NOT PERTAINING TO THAT WE ARE GOING TO MOVE FORWARD. ANYONE ELSE?
THANK YOU. >> ANY OTHER CONVERSATION, MR.
STEPHENSON ? >> I WOULD LIKE TO ADDRESS , HE ALLUDED TO THE FACT THAT REQUIRING COURSES IS NOT A BIG DEAL. AND , TO ME, IT IS A OWNERS THINK IT IS A BIG DEAL.
YOU CANNOT DECIDE HOW MUCH IT HURTS ME. AS OPPOSED TO HOW MUCH IT HURTS YOU, I DECIDE THAT. SECONDLY, YOU REFER TO
[02:00:01]
SOMETHING TO THE JUSTICE SAID IN WRITING FOR THE 9-0 SUPREME COURT AS BEING YES HE'S LIKE THAT. YOU CAN MINIMIZE WHAT THE SUPREME COURT SAYS IT DOES. WHAT I READ TO YOU WAS A QUOTE. EXACTLY WHAT THEY SAID. WHEN YOU CAN GET THE BUNCH TO AGREE ON SOMETHING 9-0, IT MEANS SOMETHING. THAT'S ALLI'VE GOT TO SAY. >> OKAY IF THERE ARE NOT ANY OF THE COMMENTS I WILL MAKE A MOTION THAT THE BOARD UPHOLD THE CENSURE RESOLUTION THAT WE HAVE PASSED AND REQUIRE THE THREE COURSES OR COMPLETED WITHIN 30 CALENDAR DAYS FROM
TODAY'S DATE. A SECOND? >> SECOND.
>> SECOND BY MISS MORRIS. ANY OTHER DISCUSSION? HEARING ON I
WILL CALL FOR A VOTE. >> I CANNOT HEAR YOU TRUSTEE
HAMILTON. >> WHAT DO YOU NEED TO HAVE
REPEATED? >> I'M SORRY YOU WERE
SOUNDING MUFFLED. >> THERE IS A MOTION AND SECOND ON THE FLOOR TO PULL THE CENSURE RESOLUTION HAVING MR. STEPHENSON COMPLETE THREE CLASSES WITHIN 30 CALENDAR DAYS.
RULING AND RESPECTFULLY REQUEST THESE CHARTERS AND REPRIMANDS BE HELD UNTIL THE CONCLUSION OF MY APPEAL.
>> WE HAVE COME TO ADJOURNMENT. THE TIME IS 9:00 P.M. WE WILL ADJOURN. THANK YOU SO MUCH AND HAVE A
