AT THIS TIME WE ARE HAVING A HEARING TO CONSIDER IMPOSSIBLE ACTION REGARDING LEVEL III GRIEVANCE HEARING FOR REGGIE MITCHELL. UNDER DDBA LEGAL.

ARE THE ATTORNEYS PRESENT? [INAUDIBLE] OKAY, BOARD, WHAT IS THE PLEASURE OF THE BOARD?

>> OKAY, CAN EVERYONE HEAR ME? ULTIMATELY THIS GRIEVANCE IS ABOUT AN APPLICANT THAT SUBMITTED HIS PAPERWORK LATE.

TRIED TO SUBMIT MOU TO ALLOW FOR COLLEGE TO GIVE CREDIT.

WHEN INSTRUCTED TO BEGIN WORK, THE DISTRICT EXTENDED A JOB, AND DID NOT SHOW UP FOR WORK. WHAT THE DISTRICT HAS DONE AT PREVIOUS LEVELS UPHOLD HIS DISMISSAL UNDER BOARD POLICY.

>> MRS. MORRIS. >> THANK YOU, I WANT TO KNOW FROM OUR ATTORNEY, IF THERE IS A -- THERE IS A GUIDELINE FOR GRIEVANCES. I DON'T WANT THE BOARD TO OVERRULE WHAT OUR GUIDELINES IN THE DAYS FOR GRIEVANCES.

ARE WE AT THAT POINT? OR ARE WE PAST THAT POINT?

>> THE BOARD -- EXCUSE ME, THE DISTRICT AND THE BOARD HAVE ACTED WITHIN THE GRIEVANCE GUIDELINES IN TERMS OF DATES, BOTH IN TERMS OF PREVIOUS LEVELS AND WHEN TO HOLD THIS HEARING.

HE WAS GIVEN TWO WEEKS NOTICE, AT THE BEGINNING OF FEBRUARY, ABOUT THREE WEEKS. AND GIVEN OFFICIAL NOTICE AND THIS MORNING WROTE IN THAT HE WOULD NOT BE AVAILABLE AND

DIDN'T TRY TO GET ON. >> SO WHAT YOU ARE SAYING WAS IT HIS ATTORNEY? OR WAS IT THE INDIVIDUAL THAT -- DID NOT ATTEMPT OR ATTEMPTED TO CALL THE DIRECT TO LEGAL THEM

UNREPRESENTED. HOWEVER I HAD DIRECT E-MAIL COMMUNICATION WITH HIM TODAY AND THAT THE DISTRICT HOLD THE HEARING AND UP TO THE BOARD TO CONDUCT IN ABSENCE.

I INFORMED IF ABSENT THE BOARD OF TRUSTEES MAY VOTE TO UPHOLD OR VOTE TO ADDRESS THE GRIEVANCE.

BUT ULTIMATELY UP TO YOU ALL. >> RIGHT AND ALSO UP TO HIM IF HE WANT TO PURSUE HIS GRIEVANCE. I'M TRYING TO FIGURE OUT WHY THE BOARD IS PUTTING IT OFF FOR ANOTHER DATE.

BECAUSE THE INDIVIDUAL WOULD HAVE TOLD YOU IF YOU WERE IN COMMUNICATING WITH HIM, THAT HE WANTED TO RESCHEDULE.

HOWEVER, I CANNOT UNILATERALLY RESCHEDULE IT ON THE DAY OF THE
